The police watchdog in Nova Scotia has announced that no charges will be filed against a Halifax Regional Police officer involved in an incident where a man was injured during an arrest in Dartmouth last year. This decision follows an investigation by the Serious Incident Response Team (SiRT), which commenced on December 11.
SiRT's investigation was triggered when officers responded to a report concerning a man wanted for various offences, including fleeing from police and theft. Authorities had also suspected that the man might have been connected to a stabbing incident. The arrest took place on Wyse Road in Dartmouth, indicating the seriousness of the situation as police were eager to apprehend a potentially violent individual.
Reports indicate that the suspect attempted to evade capture and confronted the officer, leading to a physical altercation. According to SiRT, the officer managed to tackle the man to the ground during the struggle as the suspect continued to resist arrest. In the process of gaining control over the situation, the officer delivered strikes to the suspect's face. Additional officers subsequently arrived to help with the arrest and secure the individual in custody.
Throughout the confrontation, the suspect allegedly told the officer, “take the cuffs off, it will be a different story,” suggesting an awareness of the officer's challenges during the arrest. The individual later received medical attention and was diagnosed with a broken collarbone, raising questions regarding the use of force in the operation.
During the investigation, the main officer involved conveyed to SiRT his previous encounters with the suspect, stating that he had fought him before due to a history of evasion. The officer described his assessment of the situation as “very high risk,” noting the suspect's lack of fear towards law enforcement and his perceived willingness to engage in violent acts. Furthermore, the officer expressed uncertainty over whether the suspect was armed, indicating that prior experiences had heightened his caution and concerns for the safety of both officers and civilians.
Authorities were actively pursuing the suspect, who was wanted for multiple offences, including the theft of a vehicle, which compounded the urgency of the situation at hand. SiRT concluded their findings by establishing that there were no reasonable grounds to believe that the officer had used excessive force during the arrest, thereby exonerating him from criminal charges.
This incident highlights the complex nature of police work, particularly in situations involving individuals with known violent tendencies. It underscores the challenges law enforcement officers face when navigating potential threats while ensuring the safety of the public and themselves.
